These Website Terms of Use (“Terms”) govern access to and use of www.mypilotcollection.com (the “Website”), including its customer account, enquiry, contact and other interactive features.

The Website is operated by Léa CRUSEL, individual entrepreneur, trading as MY PILOT COLLECTION (“MPC”), SIREN / RCS Albi 918 974 940, whose business address is 38 rue Édouard Branly, 81000 Albi, France.

These Terms set out the rules applicable to the use of the Website and its features. They do not replace the contractual terms applicable to purchases, commissioned projects or professional services.

By accessing or using the Website after having been given access to these Terms, users acknowledge having had the opportunity to read them. Where any provision of these Terms is relied upon as a contractual term, it applies only to the extent that it has been validly brought to the user’s attention and accepted in accordance with applicable law.


1. Applicable Terms

Any purchase of Products or Services by a Consumer is governed by MPC’s B2C General Terms and Conditions of Sale.

Any transaction with a Professional Customer is governed by MPC’s B2B General Terms and Conditions of Sale and, where applicable, any quotation, contract or Special Terms agreed between the parties.

In the event of any inconsistency concerning an Order, project or paid Service, the applicable General Terms and Conditions of Sale and any Special Terms prevail over these Website Terms.

Personal data is processed in accordance with MPC’s Privacy Policy, and cookies and similar technologies are governed by the Cookie Policy and the choices made through Cookie Preferences.


2. Access to the Website

MPC provides access to the Website for personal, professional and commercial discovery of its Products, artworks, projects and Services.

MPC may update, modify, suspend or temporarily restrict all or part of the Website where reasonably necessary for maintenance, security, technical, legal or operational reasons.

MPC does not guarantee that the Website will be available continuously or without technical interruption.

Any such modification or interruption does not affect rights already acquired under an existing Order or contract.


3. Customer Accounts

Certain Website features may require access to a Shopify customer account.

Customer accounts currently use email-based authentication and verification codes. Users are responsible for maintaining the security of their email account and must not disclose authentication or verification codes to unauthorised persons.

You must provide accurate information and must not impersonate another person, create an account using another person’s identity without authority or attempt to gain unauthorised access to another account.

MPC may take reasonable measures to secure, restrict or suspend access to an account in the event of suspected fraud, misuse, unauthorised access or security risk.


4. Website Information and Product Listings

MPC takes reasonable care to present accurate information concerning its Products, artworks and Services.

However, photographs, videos, renders, descriptions and other visual materials may not reproduce colours, textures, dimensions or artisanal characteristics perfectly, particularly because of screens, lighting, photography or the unique or handmade nature of certain Products.

A Product page, archived Product, editorial publication, price indication, “on request” reference or other Website content does not necessarily constitute a binding contractual offer.

The formation of an Order and the contractual characteristics applicable to it are governed by the applicable General Terms and Conditions of Sale and, where relevant, any quotation or Special Terms.

MPC may correct errors or update Website information. Where a contract has already been concluded, any correction remains subject to the Customer’s contractual and statutory rights.


5. Intellectual Property and Permitted Use

The Website and its contents are protected by applicable intellectual property laws.

Ownership of Website content, third-party intellectual property rights and the status of independent artistic creations referring to third-party brands, manufacturers, vehicles or models are further described in MPC’s Legal Notice.

Unless permitted by applicable law or expressly authorised in writing by the relevant rights holder, Website content may not be reproduced, represented, copied, adapted, distributed, published, commercially exploited or otherwise used, in whole or in part.

Systematic extraction, scraping, automated downloading or other unauthorised collection of protected Website content is prohibited to the extent permitted by applicable law.

To the extent that MPC is entitled to exercise or reserve the relevant rights, MPC expressly reserves the rights of the relevant rights holders and opposes, pursuant to Articles L.122-5-3 III and R.122-28 of the French Intellectual Property Code, to the text and data mining of protected Website content, including for the development or training of artificial-intelligence systems, except where applicable law provides otherwise or prior written authorisation has been obtained.

This reservation is without prejudice to the rights of artists and other third-party rights holders in their respective content.

Access to the Website and purchase of a Product do not transfer any intellectual property rights except where expressly agreed in writing.


6. Enquiries, Quotations and Project Requests

The Website may allow users to contact MPC, request information, submit an enquiry, request a quotation or provide information concerning a potential custom project.

Submitting an enquiry or project request does not by itself create an Order, require MPC to accept the project or create an obligation to supply a Product or Service.

A contract is formed only in accordance with the process described in the applicable B2C or B2B General Terms and Conditions of Sale and any relevant quotation or Special Terms.

Unless otherwise agreed in writing or required by law, submitting an enquiry does not by itself create exclusivity or a separate confidentiality agreement between the parties.


7. Content and Materials Submitted to MPC

Where you provide MPC with photographs, logos, designs, drawings, files, texts, specifications, trademarks, reference materials or other content for an enquiry, personalisation or project, you remain responsible for ensuring that you are entitled to provide and use that material for the requested purpose.

You retain any intellectual property rights you hold in such material.

You authorise MPC and, where necessary, its artists, craftspeople, manufacturers and other Partners to use the submitted material only to the extent reasonably necessary to assess, prepare, quote, develop or perform the requested project or Order, subject to the applicable contractual terms.

This limited authorisation does not transfer ownership of your intellectual property to MPC.


8. Prohibited Use

You must not use the Website:

  • for unlawful, fraudulent or misleading purposes;
  • to infringe intellectual property, privacy or other rights;
  • to introduce malware, malicious code or other harmful technologies;
  • to circumvent or attempt to compromise Website, account, payment or security systems;
  • to impersonate another person or misrepresent your identity or authority;
  • to collect personal data from other users unlawfully;
  • to interfere with the normal operation, availability or security of the Website;
  • to perform abusive automated requests, scraping, systematic extraction or text and data mining contrary to these Terms or applicable law; or
  • to use Website content commercially without the necessary authorisation.

MPC may restrict access or take appropriate measures where reasonably necessary to protect the Website, MPC, its Partners, customers or third parties from unlawful, fraudulent, harmful or abusive activity.


9. Third-Party Services and Links

The Website relies on or may link to services operated by third parties, including payment providers, social networks, carriers and other external platforms.

Third-party services are subject to their own terms, technical conditions and privacy practices.

The presence of a link or integration does not, by itself, constitute an endorsement or guarantee of the independent content or services of that third party.

Nothing in this provision affects MPC’s obligations as contractual seller where a third-party provider is used by MPC to perform an obligation owed to a Consumer.


10. Website Security

Users must not attempt to obtain unauthorised access to the Website, customer accounts, servers, systems or data.

MPC may implement fraud-prevention, authentication, monitoring and other reasonable security measures and may cooperate with Shopify, payment providers or competent authorities where necessary to investigate suspected fraudulent or unlawful activity.

The processing of personal data for these purposes is described in MPC’s Privacy Policy.


11. Liability Relating to Website Use

MPC takes reasonable measures to maintain the Website and the accuracy and security of its content and functionality.

MPC does not guarantee uninterrupted or error-free availability of the Website or compatibility with every device, browser or third-party service.

To the extent permitted by applicable law, MPC is not liable for damage resulting from the user’s own fault, an unforeseeable and unavoidable act of a third party unrelated to the performance of MPC’s obligations, or an event of force majeure.

This provision does not exclude MPC’s responsibility for third parties used by MPC to perform obligations owed under an Order where applicable law makes MPC responsible for their performance.

Nothing in these Terms excludes, restricts or reduces any liability, guarantee, remedy or other right that cannot lawfully be excluded or limited, particularly any mandatory rights available to Consumers.

Liability relating to Products, Orders, paid Services or professional projects is governed by the applicable B2C or B2B General Terms and Conditions of Sale and any Special Terms.


12. Suspension or Restriction of Access

MPC may temporarily suspend or restrict access to all or part of the Website or an account where reasonably necessary because of:

security risks; suspected fraud or unlawful activity; misuse of the Website; technical incidents; maintenance; legal or regulatory requirements; or a material breach of these Terms.

Where appropriate and reasonably possible, MPC may inform the affected user of the reason for the restriction.

This provision does not permit MPC to deprive a Consumer of rights relating to an existing Order or contract.


13. Changes to These Terms

MPC may update these Terms to reflect changes to the Website, its features, security requirements, business practices or applicable law.

The current version is identified by the “Last updated” date above.

Changes apply prospectively from their publication or from any later date stated by MPC.

They do not retroactively alter the contractual terms applicable to an Order or agreement already concluded, unless the parties validly agree otherwise or applicable law requires it.


14. Governing Law and Disputes

These Terms are governed by French law, subject to any mandatory protections applicable under the law of the Consumer’s country of residence.

For Consumers, disputes are subject to the competent courts and dispute-resolution rights provided by applicable consumer law.

For Professional Customers, any dispute relating to an Order, Service or commercial relationship is governed by the dispute-resolution and jurisdiction provisions contained in the applicable B2B General Terms and Conditions of Sale and any Special Terms.

Nothing in these Terms deprives a user of a mandatory right to bring proceedings before a court that has jurisdiction under applicable law.


15. Language

A French version of these Terms is available on the Website.

Translations may also be provided for convenience.

In the event of any inconsistency between the French version and a translation, the French version prevails to the extent permitted by applicable law.
